Merton E. Marks provides domestic and international arbitration and mediation services. He has offices in Scottsdale and Tucson, Arizona, and Orange County, California and is available to conduct arbitrations and mediations throughout the U.S. and internationally. His cases include corporate, commercial, construction, insurance, reinsurance, real estate, employment and injury litigation involving individuals, corporations and government entities. In addition to private arbitration and mediation, he has been appointed to hear cases as a special master of the Superior Court, the Arizona state trial court of general jurisdiction, and as a certified arbitrator of the U.S. District Court, the federal trial court of general jurisdiction. Prior to being an arbitrator and mediator, he was a trial lawyer for over 40 years specializing in civil litigation. He has served as a judge pro tempore on the Arizona Court of Appeals and as Assistant Attorney General of Arizona. Although he no longer practices law, he maintains active bar memberships in the federal courts and the States of Arizona and Illinois. He has been appointed to the American Arbitration Association panels on Commercial Arbitration, Large Complex Cases and Reinsurance Arbitration; certified as an Arbitrator of the Reinsurance and Insurance Arbitration Society of Association Internationale de Droit des Assurances, Geneva, Switzerland; appointed to the International Arbitration Panel of the Singapore International Arbitration Centre and designated a Fellow of the Chartered Institute of Arbitrators of London. He is also an arbitrator for the Financial Industry Regulatory Authority (National Association of Securities Dealers and New York Stock Exchange) and a member of the Inter-Insurer Arbitration Panel of the CPR Institute for Dispute Resolution, the International Lawyers Network; the International Bar Association Arbitration and ADR, Insurance, International Litigation and Products Liability Committees; and the American Bar Association Dispute Resolution Section. He served as Chair of the American Bar Association Special Committee on Federal Asbestos Legislation and as Chair of the Committee on Workers Compensation and Employers Liability Law. He was elected to the American Board of Trial Advocates based on his jury trial experience and to the American College of Legal Medicine as a result of his work in medical-legal matters. He is the former chair of the Federation of Insurance & Corporate Counsel Alternative Dispute Resolution Section. While in private law practice, much of his civil litigation practice involved representation of international clients including insurance and reinsurance underwriters, pharmaceutical and medical device manufacturers, business investors, automobile manufacturers and dealers, chemical product manufacturers, hotel groups and food supplement distributors based in the U.S., U.K., Japan, China, Canada, Sweden, Switzerland and other countries. He was national coordinating counsel civil litigation throughout the U.S. and regional counsel in trials, arbitrations, mediations, class actions, administrative hearings and appeals. He was a partner for 27 years in the Phoenix office of Lewis and Roca LLP, one of the largest law firms in the United States, where he chaired a litigation group representing clients in commercial and insurance litigation. Previously, he was a partner in the Phoenix law firm of Shimmel, Hill, Kleindienst & Bishop. He is a frequent speaker on international arbitration and mediation and on class action, product liability, insurance and securities litigation at legal conferences. He has lectured in the U.S., U.K., Canada, France, Germany, Israel and Spain and is the author of more than 50 published articles on legal subjects including “U.S. Product Liability Law” (International Lawyer, International Bar Association), “Arbitration and Mediation- Today’s Solution for Business and Sports Disputes” (national golf magazine Executive Golfer) and “New Trends in Alternative Dispute Resolution” (Voir Dire Journal, American Board of Trial Advocates). He has received the Martindale-Hubbell “A-V” rating, the highest peer review rating given for legal ability and professional ethics. He is listed in the Reinsurance Association of America Arbitrators Directory, the Martindale-Hubbell Dispute Resolution Resources Online Directory, Who’s Who in America, Who’s Who in American Law and Who’s Who in the World. He is a graduate of Northwestern University School of Law (J.D.), where he wrote for the Northwestern Law Review, and College of Arts and Sciences (B.S. in Political Science) and is admitted to practice before the U.S. Supreme Court, 9th Circuit Court of Appeals, District Court, Court of Appeals for the Armed Forces and the Supreme Courts of Arizona and Illinois. He served in the U.S. Army Infantry and as a captain in the Judge Advocate General’s Corps.
