A Great Victory!

WolfBlock attorneys in the firm's Roseland, NJ office, Carl Soranno and Jonathan Bick, along with associate Adelaide Riggi secured the exclusive right to use the trademark JERSEY SHORE in reference to radiological and imaging medical services in the Jersey Shore area of New Jersey for client Jersey Shore Radiology Associates by litigating this matter in the United State District Court for the District of New Jersey. This achievement is noteworthy for two reasons.

First, geographic terms such as JERSEY SHORE are ordinarily unprotectable because they do not perform the trademark function of distinguishing the business source or origin of the product. In this case, the WolfBlock attorneys demonstrated it was legally protectable because it had attained a secondary meaning.

Second, this matter was resolved in about a month. The WolfBlock team achieved this result by requesting a preliminary injunction with accelerated discovery  rather than focusing on temporary restraints.  By focusing on irreparable  injury to the client the matter was resolved expeditiously.  As desired by our client, our client's adversary was permanently restricted from using JERSEY SHORE in association with its business, in short order.

 


Jerome J. Shestack Appointed Chairman of ABA’s

Center for Human Rights

 

            PHILADELPHIA—March 4, 2004—Jerome J. Shestack has been appointed Chairman of the American Bar Association’s Center for Human Rights by ABA President, Dennis Archer.            

 

The Center for Human Rights coordinates the ABA’s many human rights activities, including sending observers to human rights trials, rule of law interventions in cases of human rights abuses, support of human rights treaties and liaisons with other human rights organizations.            

 

Other members of the Center’s Executive Board include Justice Ruth Bader Ginsburg of the Supreme Court of the United States; two former ABA presidents, Reece Smith and Jack Curtain; former International Bar Association President Giuseppe Bisconti; Father Robert Drinan, Georgetown School of Law; Llewellyn Pritchard of Seattle, Washington; and Steve Walther of Reno, Nevada, the immediate past Chairman of the Center.            

 

The Center will also have an Advisory Council of leading human rights academics and activists.  “An initial emphasis of the Center will be to focus on the widespread abuse of women’s rights around the world, including such matters as trafficking, genital mutilation, stoning, and other abuses,” Mr. Shestack explained.  “Another Center project deals with highlighting widespread torture practices.”  Recently the Center sent U.S. District Court Justice Bernice Donald to Zimbabwe to observe the trial of a judge.  The charges were then withdrawn.            

 

The Center will also seek to promote human rights committee in state and local bar associations and establish liaisons with leading non-NGO human rights organizations.            

 

Mr. Shestack is a Partner in WolfBlock and co-Chairs its Business Litigation Practice Group.  He is a former President of the American Bar Association and served as U.S. Ambassador to the U.N. Commission on Human Rights during the Carter Administration.  He is a counselor to the American Society of International Law and a Commissioner of the International Commission of Jurists and Honorary President of the International League for Human Rights.  He has written widely on human rights issues.  


 

Diana C. Liu Elected a Fellow of The American Bar Foundation

 

            PHILADELPHIA—February 26, 2004—Diana C. Liu, a Partner in WolfBlock’s Real Estate Practice Group, has been elected a Fellow of the American Bar Foundation.              

 

The American Bar Foundation is the preeminent research center for the empirical study of law, legal institutions, and legal processes in society.  The Fellows is an honorary organization of practicing attorneys, judges, and law teachers whose professional, public, and private careers have demonstrated outstanding dedication to the welfare of their communities and to the highest principles of the legal profession.  Established in 1955, the organization of The Fellows encourages and supports the research program of the American Bar Foundation.            

 

Ms. Liu’s practice concentrates in the acquisition and development of commercial real estate, including shopping centers; acquisition of office buildings and industrial parks; and in the representation of lending institutions in loan transactions and complex loan workouts.  She also has experience in representing owners in connection with restaurant management agreements and hotel operators in connection with hotel management agreements.            

 

Ms. Liu received her B.A. from Johns Hopkins University in 1983 and her J.D. from Cornell University in 1986.   She is a member of the American College of Real Estate Lawyers, the American Law Institute, the National Asian Pacific American Bar Association Partners Network; 1999 President and former Executive Committee member of the Asian American Bar Association of the Delaware Valley; and member of the Philadelphia Bar Association Fee Disputes Committee.  Ms. Liu is a past member of the Philadelphia Bar Association Board of Governors and Young Lawyers Executive Committee; former Trustee of the Philadelphia Bar Foundation; past participant of the American Corporate Counsel Association Leadership Summit;  and past member of the House of Delegates of the Pennsylvania Bar Association.  

           

 

She is past president and current member of the Asian American Women's Coalition, and is on the Board of CORA Services, Inc.  She served on the Board of Directors of Big Brother/Big Sister Association of Philadelphia through 1997.  Ms. Liu is a member of the Johns Hopkins University Alumni Council, member of the Zanvyl Krieger School of Arts & Sciences Second Decade Society, and immediate past National Chair of the Second Decade Society (1997-1998).


WolfBlock Partner Inducted as Bar President Cheryl Young to lead Montgomery Bar Association 

PHILADELPHIA, PA—January 16, 2004—Cheryl L. Young, a partner in WolfBlock’s Family Law Practice Group, was inducted as the Montgomery Bar Association’s 74th president in Norristown. 

Ms. Young outlined a number of goals for the upcoming year.  One of her first priorities will be to continue to strengthen Montgomery Bar Association’s relationship with the legislature.  Young plans on strengthening the relationship through annual Day on the Hill outings, as well as, through the professionalism committee that she has established here at the Bar Association.  Another aspect of the Bar Association that Young would like to work on is the MBA’s website.  “I would like to revitalize MBA’s website.”  One project she would like to see get off the ground is having the Legal Directory accessible online with a membership picture directory.   

Young has already implemented a new committee on professionalism. “As our lawyers continue to focus more and more on one area of practice, and the number of lawyers continues to grow, it is imperative that we continue to maintain our role as professionals and not just view ourselves as businessmen.  As this becomes more difficult in more challenging times, it also becomes more relevant.  I am looking forward to this committee taking an active role with the Bar Association.”   

In addition to creating the professionalism committee, Young says the key to a successful presidency is working with others.  “Although the president is the captain of the ship, it is my view that a president’s success rests, in large part, on those people who provide support and back up,” said Young.  “I also think it is important to be out front with leadership and be willing to address issues promptly, regardless of whether they are controversial or unpleasant.” 

According to Young, some of her most important goals as president are to “make sure our website reflects the high quality of our lawyers and our Bar Association.  I also want to stay on top of all that is happening in the legislature because I believe there are constant proposals and bills put forth that could significantly alter and potentially hurt lawyers’ ability to practice law in this Commonwealth.  Finally, I want to continue to improve membership services so that we can maintain the high level of involvement of our current members and attract new members to this Association.” 

 

Ms. Young, a resident of Maple Glenn, Pennsylvania, practices in WolfBlock’s Norristown office.  She is a member of the firm’s Executive Committee.  She concentrates her practice in matrimonial law, which includes divorce, custody, support, property distribution and abuse actions.  Ms. Young received her undergraduate degree from Michigan State University in 1982 and her J.D. from American University, Washington College of Law in 1985.  In addition to practicing law, Ms. Young is a member of the Pennsylvania Bar Association House of Delegates and is a past chair of the Montgomery County Family Law Section from 1994 to 1995.  She has also served as President of the Victims Service Center, a director of Ambler YMCA and a member of the Children and Youth Multidisciplinary Team. 


WolfBlock Elects Three New Partners 

            PHILADELPHIA, PA—February 2, 2004—WolfBlock is pleased to announce that Nathan E. Kase, Laura E. Krabill and Peter T. Wakiyama have all been elected as partners in the firm.              

 

Mr. Kase is  a member of the firm's Business Litigation Practice Group and concentrates his practice in the areas of commercial, intellectual property and trade secret litigation and antitrust law.  He received his B.A., magna cum laude, in 1991 from the University of Pennsylvania, where he was elected to Phi Beta Kappa.  He received his M.A. and his J.D., cum laude, in 1995 from the University of Pennsylvania where he served as Editor of the University of Pennsylvania Journal of International Business Law.  He was awarded the John G. Maurer Prize in criminal law.  From 1996 to 1997, Mr. Kase was Law Clerk to the Honorable Daniel H. Huyett, 3rd, U.S. District Court, Eastern District of Pennsylvania.   He is admitted to practice in Pennsylvania and New York.     

 

       

 

Ms. Krabill is a member of the firm's Business Litigation and Intellectual Property and Information Technology Practice Groups and focuses in the areas of general commercial litigation, including securities fraud, patent infringement, contract disputes and corporate mismanagement.  Ms. Krabill was the co-author of Federal Courts Deeply Divided over Securities Fraud Intent Standard after litigating an issue of first impression in the Third Circuit Court of Appeals on the impact of the Private Securities Litigation Reform Act on pleading requirements in securities fraud cases.  She was also a member of the American Inns of Court.  Ms. Krabill graduated, summa cum laude, from North Carolina State University in 1991 with bachelor degrees in both Electrical and Computer Engineering.  She received her J.D., cum laude, from Georgetown University Law Center in 1995 where she was on the staff of the Law and Policy in International Business Journal.  She is admitted to practice in Pennsylvania and is also a member of the United States Patent Bar. 

           

 

Mr. Wakiyama is a member of the Intellectual Property and Information Technology Practice Group.  Formed in early 1996, Mr. Wakiyama was one of the original members of the group.  He focuses his practice in the following areas:  computer law, with emphasis on information technology development, licensing and transfer;  technology outsourcing; e-commerce and Internet related matters; copyrights, trademarks, domain names and trade secrets, including general counseling, transactional matters and litigation; privacy; and entertainment and the arts, including publishing agreements, author and artists agreements, agency agreements, legal issues pertaining to promotions (such as contests and sweepstakes), publicity rights, recording agreements, and video and audio production agreements.  He received his B.A., cum laude, from LaSalle University in 1988 and his J.D., cum laude, from Temple University School of Law in 1995.  Mr. Wakiyama has served as an adjunct member of the faculty of LaSalle University, where he has taught e-commerce law to students in LaSalle's executive MBA program.  Prior to joining the firm, Mr. Wakiyama was a Senior Technical Analyst with PRC, Inc. (now part of Northrop Grumman Corporation) for seven years. His work in that capacity involved the development and support of information systems for government clientsevaluation, selection, implementation and marketing of emerging software technologies in the areas of electronic publishing and document management, particularly with regard to Internet-based publishing.  Mr. Wakiyama is a member of the Philadelphia Intellectual Property Law Association, the Computer Law Association, and has served as an Executive Committee Member of the Asian American Bar Association of the Delaware Valley.


WolfBlock’s $100,000+ for 100+ YearsFirm announces significant charitable contributions to benefit area’s needy, children 

 

            PHILADELPHIA—March 25, 2004—Celebrating its first century as a part of Philadelphia’s legal landscape, WolfBlock is pleased to announce it will give a total in excess of $100,000 to several charitable organizations, demonstrating its continued support to the communities in which it thrives.            

 

The organizations selected include: Big Brothers and Big Sisters of America, which will receive $25,000 for its continued efforts to improve the lives of children across the nation; the Philadelphia Bar Foundation, which provides legal services for those who cannot afford them, will receive $50,000; and $10,000 will be given to Cerebral Palsy of New Jersey.  Other organizations selected to each receive $5,000 are SCAN (Stop Child Abuse Now), a Philadelphia based organization that works to prevent, treat and stop the cycle of child abuse, neglect and exploitation; Kids in Distressed Situations (K.I.D.S.), a national organization based in New York that serves children in need; Food for the Poor based in New York, which provides food and shelter to the poor; Cure Autism Now (CAN), a national organization committed to accelerating the pace of biomedical research in autism through research, education and outreach; Children’s Village, a child care and education center in Philadelphia’s Chinatown section that services approximately 250 children from low-income families; The Joshua Kahan Fund in New Jersey, for its work in pediatric leukemia research; and Foundations, a national organization that provides pre-school and post-school enrichment activities for children.            

 

Mark L. Alderman, Chairman of WolfBlock, will present the contributions to a representative of each of the organizations at a dinner at the Pennsylvania Academy of Fine Arts on Saturday, March 27 at 8:30 p.m. 

           

“I believe it is the responsibility of every corporate citizen to contribute in some fashion to its community.  We have selected organizations that provide superior services to the most marginalized populations as the recipients for our support,” Alderman explained.  “Targeting our resources in this fashion allows us to help those in our community in a meaningful way.”


Jay A Dubow Elected a Fellow of The American Bar Foundation

 

            PHILADELPHIA—April 22, 2004—Jay A. Dubow, a Partner in WolfBlock’s Business Litigation Practice Group and Chair of the firm’s Securities Litigation Group, has been elected a Fellow of the American Bar Foundation. 

 

            The American Bar Foundation is the preeminent research center for the empirical study of law, legal institutions, and legal processes in society.  The Fellows is an honorary organization of practicing attorneys, judges, and law teachers whose professional, public, and private careers have demonstrated outstanding dedication to the welfare of their communities and to the highest principles of the legal profession.  Established in 1955, the organization of The Fellows encourages and supports the research program of the American Bar Foundation.

 

            Mr. Dubow’s practice concentrates in complex business litigation with a special emphasis on securities class action litigation and representing clients involved in investigations by the United States Securities and Exchange Commission, the Pennsylvania Securities Commission and various self-regulatory organizations, including stock exchanges and the National Association of Securities Dealers.  Prior to joining WolfBlock, Mr. Dubow was a Branch Chief in the Division of Enforcement of the United States Securities and Exchange Commission in Washington, D.C.

 

            Mr. Dubow received his B.S. magna cum laude from the Wharton School of University of Pennsylvania in 1981, where he majored in Finance and Accounting. He received his J.D. from the University of Pennsylvania Law School in 1984. Mr. Dubow is admitted to the District of Columbia and Pennsylvania Bars. He has served as the Chairman of the Federal Courts Committee of the Philadelphia Bar Association (1997), and is a Co-Chairman of the Business Litigation Committee. He also is a Co-Chairman of the Municipal Securities Litigation Subcommittee of the Litigation Section of the American Bar Association.

 

            Active in the community, Mr. Dubow is a former Chairman of the Board of Directors of the National Kidney Foundation of the Delaware Valley, a member of the Board of the Penjerdel Council and the Board of the Philadelphia Chapter of the American Committee for the Weizmann Institute of Science, and a member of the Advisory Board of Wharton magazine.


Daniel J. Clifford Elected to Leadership Roles in Local Bar Association 

Philadelphia, PA—January 23, 2004Daniel J. Clifford, a partner in WolfBlock's Family Law Practice Group, has been elected as Chair of the Family Law Section and as a member of the Board of Directors of the Montgomery Bar Association. 

 

Mr. Clifford has also been appointed to the Bar Association’s Executive Committee.   Mr. Clifford's practice concentrates in matters involving divorce, equitable distribution of marital property, child custody, support, protection from abuse, domestic and international adoptions and civil contempt matters.  He is active in the area of International Child Custody issues and has received recognition from the National Center for Missing and Exploited Children and the Philadelphia Volunteers for the Indigent Program for his representation of clients in this subject area.  

Mr. Clifford received his B.A. from Indiana University of Pennsylvania in 1981 and his J.D. from University of Baltimore in 1984.   

Also active in the community, Mr. Clifford has served as Chairman of the Zoning Hearing Board in Springfield Township, Montgomery County, since January 1997.  He is also a member of the Board of Directors of Adoptions From The Heart, a non-profit adoption agency with offices in six states.


WolfBlock Lawyer Honored by Philadelphia Estate Planning Council

 

PHILADELPHIA, PA—January 21, 2004—Matthew H. Kamens, a member of  WolfBlock’s Private Client Services  Group, was  awarded the Philadelphia Estate Planning Council’s 2003 Distinguished Estate Planner Award at the organization’s luncheon yesterday afternoon. 

The award is presented to an individual in recognition of outstanding contributions in the field of estate planning.  The Philadelphia Estate Planning Council is a highly recognized interdisciplinary organization for professionals involved in estate planning, providing its members with opportunities to enhance their skills and expand their network through programs and interaction.  

Mr. Kamens concentrates his practice in trust, estate and business planning, and complex estate administration and is a member of the firm's Private Client Services Group.  He has significant knowledge of life insurance and its structuring in estate planning contexts.  He is a fellow of the American College of Trust and Estate Counsel, an emeritus member of the CCH Financial and Estate Planning Advisory Board, and has lectured on estate planning at the graduate tax programs of both Temple and Villanova Universities.  For several years, Mr. Kamens was a principal and the director of Wealth Transfer and Executive Benefits at CMS Companies, a personal investment banking firm in Philadelphia, where he specialized in  estate/business planning and insurance funding techniques for wealthy business owners. 

Mr. Kamens has served as Co-Chairman of the Board of Trustees of the National Museum of American Jewish History, and as a Vice President and a member of the Board of Directors and Executive Committee of the Federation Endowments Corporation.  He is a member of the Board of Directors of the Jewish Federation of Greater Philadelphia.  He is also a member of the Board of Directors of Jones Apparel Group.
